Last Will is a document where you tell your family how you want your property be disposed of after your death. In the Last Will & Testament you appoint an Agent, called an Executor, to take care of your estate. An Executor will pay your debts, funeral expenses, and distribute your property as you direct her/him in your Last Will.
In order to execute a valid Will a person must have testamentary capacity, meaning that an executor of a Will must be of sound mind at the time of signing a Will and understand the nature of this legal document. Any person 18 years old can make a Will.
Laws regulating wills differ from state to state, but there are several "universal" requirements that must be satisfied to have a valid Last Will.
To avoid future confusion and likely challenge of a Will it must be put in writing.
The Last Will has to be properly executed. It has to include a statement at the end of the document attesting that it is your Will, the date and place it is signed, statement of witnesses to your signature.
